The Mediation Process

Step 1. Initial contact

One or both parties contact us. The mediator then makes contact with each of the parties in dispute and sends them documentation explaining the mediation process.

Step 2. Agreement to Mediate

If the parties agree to engage in mediation they will both be required to sign an Agreement to Mediate document. This lists the rules for engaging in the mediation process. We will take care of the practicalities, the where and the when.  It may be necessary to compile a budget sheet if finances are involved, a template will be provided by us

Step 3. Separate Meetings

The first meetings will be separate.  We use this meeting with the parties to hear about the dispute and to facilitate the parties to focus clearly on the issues they want to bring to the mediation.

Step 4. Joint Session

Subsequent meetings will be joint sessions where both parties are involved.  It may be necessary during the process to meet with one or both parties separately again, this is known as caucusing.

Step 5. Agreement

Once a final agreement has been reached a Final Mediated Agreement will be drawn up by us which both parties will sign. The parties may then choose to bring this agreement to each of their solicitors in order to make it legally binding.  A Mediation agreement in itself is not a legally binding document.
